Home / HSS Denies Florida's Request for MLR Waiver
The United States Department of Health and Human Services has denied Florida’s request for a waiver from implementing the Minimum Loss Ratio Requirements of PPACA. NAIFA Florida was supportive of Kevin McCarty’s request for a delay in implementing the MLR’s, based upon the destabilizing effect they are having on the health insurance market in Florida, and on agent commissions in particular. Frankly, we hoped that the waiver request, coupled with a potential supreme court decision overturning all of PPACA, would have helped chart a path towards re-establishing a stable market here in Florida. We appreciate Kevin's leadership on this issue, and will fight on with legislation in Congress to exempt agent commissions from the MLR requirements, and will support efforts to strike down and eliminate PPACA in the courts and in Congress.
